Australian tax residency when moving to Argentina

Moving to Argentina does not automatically end Australian tax residency. The ATO applies four tests, and a change partway through the Australian income year can affect your tax-free threshold and capital gains.

Moving to Argentina does not automatically end Australian tax residency: the ATO applies four tests, and satisfying any one can keep you resident. Spending 183 days in Argentina does not, by itself, switch off Australian tax residency; the Australian 183-day test counts time in Australia during its income year.

How does Australia decide if you remain a tax resident?

The ATO starts with the resides test: where you actually live. It considers physical presence and the purpose of your stay, alongside family, work, assets and social ties. If you do not satisfy it, any of the other three tests can still make you resident. Citizenship, an Argentine visa and a flight booking are not substitutes for that analysis.

That last test is narrow but consequential for Australian government workers posted abroad. The domicile and resides tests are why an indefinite move, an overseas lease and where your family lives matter more than a calendar shortcut. Record when your living circumstances changed; a departure date alone cannot establish when you ceased Australian tax residence.

What changes in the Australian return for the year you leave?

Australia's income year runs from 1 July to 30 June. If your circumstances make you a foreign tax resident partway through that year, the ATO's part-year tax-free threshold is AUD $13,464 + (AUD $4,736 ÷ 12 × months resident). Count the month in which you ceased to be resident. The ordinary full-year AUD $18,200 tax-free threshold does not simply carry over to a part-year resident return.

The ATO illustrates the rule with a person who changes to foreign residence on 22 December 2025: six resident months produce a threshold of AUD $15,832. That is an example of the arithmetic, not a rule that December departures always have the same residence outcome. Report the residence change in the Australian return for the relevant income year.

If you remain an Australian tax resident while overseas, the ATO says to lodge a return and declare foreign employment income. This includes income exempt in Australia or subject to foreign withholding. Foreign tax deducted from pay is not proof that Australia has stopped treating you as resident. Once you cease Australian residence, Australian-source income and Australian assets can still create Australian filing or tax obligations; nonresidence does not mean closing your ATO account.

Why should you assess shares and a former home before departure?

Ceasing Australian tax residence can cause a deemed disposal for capital gains tax (CGT) on assets other than taxable Australian property. The ATO describes a choice to disregard that deemed disposal, but it changes later CGT treatment. A share portfolio can therefore need attention even without an actual sale. Work through the options before making a choice in the departure-year return.

A former Australian home brings a separate risk. The CGT main-residence exemption may not be available if you sell as a foreign resident after 30 June 2020, apart from specified life-event conditions. Do not rely on the usual six-year absence rule to protect a sale made while foreign resident. A property-specific tax assessment before departure or sale is more useful than discovering the exemption problem after signing a contract.

When can Argentina also treat you as a tax resident?

ARCA, Argentina's tax authority, says a foreign national becomes an Argentine income-tax resident on acquiring permanent residency, or after 12 months under temporary residence authorisations without acquiring permanent residency. ARCA's separate more-than-six-month rule concerns personal deductions, not that general foreign-national tax-residence trigger. Argentine income-tax residents are generally taxed on Argentine and foreign gains, while nonresidents are generally taxed on Argentine-source gains. These rules can overlap with Australia's tests during a move; becoming resident in one country does not automatically end residence in the other. If both domestic systems treat you as resident, Article 4 of the Australia–Argentina double tax agreement first looks at where a permanent home is available, then, when homes are available in both countries or neither, at where personal and economic relations are closer. That treaty analysis allocates residence for treaty purposes; it is not a substitute for establishing your position under each country's domestic law.

What should you do before and after leaving?

  1. Before departure, document your circumstances. Note where you and your family will live, your employment, the Australian home and other assets, and when the arrangements change. Those facts feed the ATO's resides and domicile tests.
  2. Model Australian CGT before selling or choosing. Ask an Australian tax adviser about shares, any deemed disposal and the main-residence position while there is still time to plan a sale.
  3. Identify your departure-year residence periods. Use the actual change of circumstances and the ATO's part-year rule when preparing the relevant return; a passport stamp alone does not establish the date.
  4. Assess Argentine tax residence separately. Your Argentine immigration status and time under temporary authorisations matter under ARCA's rules. Coordinate returns and any treaty claim if both countries tax the same income.

For dual residence or a CGT choice, seek cross-border advice against your actual dates and assets before lodging. The treaty may affect how income is taxed, but it does not erase either country’s domestic residence tests.

Does 183 days in Argentina end my Australian tax residency?

No. The Australian 183-day test counts days in Australia during the Australian income year, and the other residency tests can still apply.

Do I pay Australian tax on Argentine employment income after moving?

If you remain an Australian tax resident, the ATO says to declare foreign employment income in your Australian return, even if Argentina has withheld tax or the income is exempt in Australia.

Does leaving Australia trigger CGT on shares I have not sold?

It can. Ceasing tax residence can cause a deemed disposal of assets other than taxable Australian property; the ATO also describes a choice with later CGT consequences.

Can I sell my former Australian home tax-free while living in Argentina?

Not necessarily. A foreign-resident sale after 30 June 2020 may lose the main-residence exemption except in specified life-event circumstances.
